In this session, we provide an update on the duty of candour; touching on the professional and statutory duties. There is a particular emphasis on Regulation 20(2), which is the specific duty placed upon health service bodies to (as soon as reasonably practicable after becoming aware of a ‘notifiable safety incident’) notify the ‘relevant person’ that the incident has occurred and provide ‘reasonable support’. We drill down into the various definitions and the applicable ‘harm thresholds’, looking at several CQC worked examples and providing guidance on how to best discharge the duty and avoid regulatory action.
