Annual Mental Capacity Act and Deprivation of Liberty

Content

Our Healthcare Advisory Teams across our national offices joined together to deliver our Annual Mental Capacity Act and Deprivation of Liberty Webinar in November 2021.

The Webinar provides you with an up-to-date view of case law and legislation tailored to address the issues which face both commissioners and providers of healthcare. The Webinar has been split into four parts:-

Part 1 - Case law update

This part of our Webinar, delivered by Emma Pollard (Senior Associate, London) and Amy Clarke (Senior Associate, Manchester), touches on the following topics:

  • Avoiding criticism in obstetric cases
  • Withdrawal of treatment in the context of Covid-19
  • Validity of Advance Decisions
  • Right to access a sex worker
  • Going to the ECHR and UN in withdrawal of treatment cases
  • Contact and coercive control

Part 2 – Liberty Protection Safeguards: update and next steps

This part of the Webinar is delivered by Ben Troke (Partner, Leeds). Ben highlights the current updates regarding the LPS, and what we may expect in the near future.

Part 3 - Covid 19 impact and vaccinations

In this part of our Webinar, Rachel Kelly-Brandreth (Senior Associate, Liverpool) discusses the process which we use to vaccinate those who lack capacity to make a decision around the Covid-19 vaccination.

Rachel covers the recent Case law to give you an idea of what is required by the Court to make those decisions, and what information is considered when making these type of Best Interest decisions.

Part 4 – Deprivation of Liberty: Children and young people

Louise Wilson (Legal Director, Liverpool) explains the following areas in relation to Deprivation of Liberty for Children and young people:

  • What is a DoL for Children and young people?
  • When does this require Court involvement?
  • Which Courts are available for authorising a DoL for Children and young people
  • Public Judgements
